SUBJECT:- Stepping up of the pay of senior category III & IV employees equal to their junior employees on IDA pattern-guidelines/instructions- regarding.

Consequent upon implementation of revised pay scales on IDA pattern w.e.f. 1-1-97 vide Headquarters Circular no. WR-09-2002-04 dated-19.2.2002 (WRC/1/5/2001), in certain cases the pay of the senior employees might have got fixed at amount less than that of his/her junior. The cases where such anomalies might have arisen could be as follows:-
(i) A senior employee promoted to a higher post before 1.1.97 drawing less pay in the revised scale than his junior who is promoted to the higher post after that date.
(ii) The senior employee placed in Selection Grade on completion of 12 years service in a grade before 1.1.97 drawing less pay in the revised scale than his junior who was placed in Selection Grade on completion of 12 years service on or after 1.1.97.
2. In order to address such anomalies, if arisen on or after 1.1.97, the pay of the senior should be stepped up to an amount equal to the pay of his junior. The stepping up should, however, be done w.e.f. the date of promotion/placement in selection grade of the junior employee, as the case may be, subject to fulfillment of the following conditions:-
(i) Both the junior and senior employees should belong to the same cadre in the lower as well as higher post.
(ii) Both the junior and senior are/were in the same pre-revised and revised scales of pay in the lower and higher posts.
(iii) Senior was drawing more or equal pay in the lower post before 1.1.97 in pre-revised scale as compared to his junior.
(iv) That the anomaly should be directly as a result of the application of the provisions of Regulation 82 of FCI(Staff) Regulations, 1971, and/or instructions with regard to pay fixation for placement of Cat.III & IV employees in the respective selection grade scale. However, in the lower post the junior employee was drawing more pay in the pre-revised scale than the senior by virtue of any advance increments granted to him, provisions of this circular need not be invoked to step up the pay of the senior.
(v) The employee whose pay has been refixed with reference to Circular No. 5 of 1995 dated 1.5.1995 shall not be eligible for stepping up of their pay at par with their juniors in view of the pre-condition laid down therein. The employee senior to them shall also not be entitled for stepping up of pay at par with such junior employee who got his pay fixation benefit under Headquarters Circular no. 5 of 1995 dated-1.5.1995.
3. Every case has to be examined/decided with the approval of the competent authority as prescribed in headquarters Circular No. 02 of 2005 dated-19.1.2005 (File No.EP.8(1)/2005) after obtaining the concurrence of the Deputy Genl. Manager(Fin.) of the respective office. In case Deputy Genl. Manager(Fin.) is not in position, concurrence of the Asstt. Genl. Manager(Fin./Accounts) may be obtained as the case may be.
4. Cases of the seniors drawing less pay than their immediate juniors because of the reasons other than specified above and also because of any penalty imposed, shall not come within the purview of the circular.
